Here is what the comp carrier will not tell you: workers’ compensation pays nothing for pain and suffering. It covers medical treatment and a portion of lost wages, and that is the design of the system — no-fault benefits in exchange for limited damages.
But if someone other than your employer contributed to your injury, a separate claim may exist that does compensate pain and suffering. In a processing or manufacturing setting that third party is often the manufacturer of a machine that lacked an adequate guard, a maintenance contractor, a staffing agency, or the owner of the premises. Those cases are worth substantially more than the comp claim running beside them.
They also get missed constantly, because nobody in the workers’ compensation process has any incentive to raise them. If you were hurt by equipment, it is worth having someone look at the equipment.
I-80, US-281 and Harvest Traffic
The I-80 and US-281 interchange south of the city is one of central Nebraska’s busiest freight junctions, mixing long-haul trucks with local traffic. US-281 and US-34 carry heavy agricultural equipment during planting and harvest, and the encounter between a highway-speed vehicle and a slow-moving implement on a two-lane road is among the most lethal crash types in the state.
Farm equipment cases have their own complications — questions about lighting and marking, about whether the implement was operated lawfully on the roadway, and about the equipment’s condition. They are not ordinary car crashes and should not be worked as though they were.
